Terms of Service

These are the rules for using Crewtera. We've kept them as plain as we can.
Who we are
Crewtera is software for companies that sell, install and service (HVAC, plumbing, electrical, solar and similar trades). It is provided by Crewtera Inc. ("Crewtera", "we", "us"), [mailing address].
These Terms are an agreement between Crewtera and the company that signs up to use it ("Customer", "you"). The person accepting them confirms they have authority to bind that company. If you and Crewtera sign a separate written agreement, that agreement wins where the two differ.
The service
Crewtera gives your company an online workspace for your sales, installs, service tickets, dispatch, crews, customers, funding tracking and reports (the "Service"), on the web and on mobile devices.
We keep improving the Service. We may add, change or retire features. If we remove something you rely on in a major way, we'll tell you ahead of time when we reasonably can. Features marked "coming soon", "beta" or "preview" may change or be withdrawn and are provided as is.
Accounts, seats and your team
- Invite-only. We set up your company account. Your admins then invite your team. Each invited person gets their own login.
- Seats. Your plan includes a number of seats (user logins). Each person needs their own seat; logins may not be shared.
- Roles. Your admins choose each person's role, which controls what they can see and do. You are responsible for giving the right access to the right people and removing people who leave.
- Security. Keep passwords private and tell us right away at hello@crewtera.com if you think an account has been misused. You are responsible for activity under your company's accounts.
- Accurate info. Keep your company and billing details up to date.
Fees, billing and pausing
- Pricing. Your price is set per company, usually a monthly amount based on seats plus a one-time setup fee, as shown in your order or invoice.
- Billing. Fees are billed in advance and are due as stated on the invoice. Fees don't include taxes; you're responsible for applicable taxes.
- Late payment. If an invoice is unpaid more than [15] days after it's due, we may pause your company's access after giving you notice. Your data is kept safe while paused, and access comes back when the balance is paid.
- Changes. We'll give at least 30 days' notice before changing your price. Changes start at your next billing period.
- Refunds. Fees already paid aren't refundable, except where the law requires or we agree in writing.
Your data
Your data is yours. Everything your company puts into Crewtera (customers, jobs, tickets, photos, documents, invoices, funding details and the like) is "Customer Data", and you own it.
- You give us permission to store, process and display Customer Data only as needed to run, secure, support and improve the Service for you.
- We don't sell Customer Data and we don't use it to market to your customers.
- You're responsible for having the right to put Customer Data into Crewtera, including any notices or permissions your own customers need (for example, before you text or email them through the Service).
- How we handle personal information is explained in our Privacy Policy.
- We may use aggregated, anonymous statistics (which can't identify you, your customers or your people) to understand and improve the Service.
Acceptable use
Don't use Crewtera to:
- break the law, or store or send anything you don't have the right to;
- send spam or messages people haven't agreed to receive;
- try to access another company's data, probe or attack the Service, or get around its security or seat limits;
- copy, resell or build a competing product from the Service;
- upload malware or anything harmful.
We may suspend access that puts the Service, other customers or the public at risk, and we'll tell you why.
Other services we work with
Crewtera relies on trusted providers for hosting, databases, maps, scheduling and email. Some features connect to services you choose (for example, your calendar or a lender's website). Your use of a third-party service is also subject to that provider's terms.
Availability and support
We work to keep Crewtera available and fast, but we don't promise it will be uninterrupted or error-free. We may do planned maintenance and will try to schedule it outside normal working hours. Support is by email at hello@crewtera.com.
Our property and feedback
Crewtera (the software, design, logo and name) belongs to us. These Terms give you the right to use it while your subscription is active; they don't transfer ownership. If you send ideas or feedback, we may use them without owing you anything.
Confidentiality
Each of us will keep the other's non-public business information confidential and use it only for this relationship, except where the law requires sharing it.
Ending the subscription
- You can cancel at the end of any billing period by emailing hello@crewtera.com.
- Either of us can end the agreement if the other seriously breaks these Terms and doesn't fix it within 30 days of notice.
- Getting your data out. For 30 days after the subscription ends, you can ask us for an export of your Customer Data. After that, we delete it from the live Service; backups clear on their normal schedule.
Disclaimers
Crewtera is a tool to help run your business; you remain responsible for your own work, pricing, permits, financing decisions and how you treat your customers. Except as stated in these Terms, the Service is provided "as is" and we disclaim implied warranties, including merchantability and fitness for a particular purpose, to the extent the law allows.
Limits of liability
To the extent the law allows: neither of us is liable to the other for lost profits, lost revenue or indirect, special or consequential damages; and each party's total liability under these Terms is limited to the fees you paid Crewtera in the 12 months before the claim. These limits don't apply to your payment obligations or to either party's fraud or intentional misconduct.
Claims from others
You'll defend us against claims from third parties that come from Customer Data you put in Crewtera or from your use of the Service in breach of these Terms. We'll defend you against claims that the Service, used as allowed, infringes someone's intellectual property.
Law and disputes
These Terms are governed by the laws of [your state], without regard to conflict-of-law rules. Disputes go to the state or federal courts located in [county, state]. Before going to court, we'll both try in good faith to resolve the issue by talking it through.
Changes to these Terms
We may update these Terms. For material changes we'll notify your company's admins by email or in the app at least 30 days before they take effect. Continuing to use Crewtera after that means you accept the updated Terms.
